The terms of using Bayti.

Effective June 2, 2026

These terms apply whenever you use Bayti as a customer, vendor, or visitor. By creating an account or placing an order you confirm you’ve read and agree to them. Read the Privacy Policy alongside this document; both apply together.

1. Who we are, and what Bayti is

Bayti is a halal-food marketplace operated by Bayti LLC, a Delaware limited liability company. Bayti connects customers with independent home chefs, halal stores, and farms (collectively, “vendors”). Bayti is the marketplace platform; we are not the seller of the food itself. Vendors are responsible for what they cook, how they describe it, and what they deliver. Bayti collects payment and dispatches couriers where applicable, but the food itself is the vendor’s product.

2. Your account

You must be at least 18 years old to create a Bayti account. You are responsible for the activity on your account; keep your password and access to your email secure. You agree to provide accurate information when you sign up, and to update it if it changes.

You can close your account at any time by emailing hello@getbayti.com. We may suspend or close accounts that violate these terms.

3. Placing an order

When you place an order on Bayti, you authorize a charge to the payment method you provide (processed by Stripe). The price you see at checkout is the price you pay; we do not add hidden fees after the fact. The customer breakdown at checkout will always show food, service fee, delivery (where applicable), and any tip you choose.

Each cart is tied to a single vendor so that prep and fulfillment stay coordinated. To order from two vendors, place two separate orders.

4. Refunds

We default to fairness. If you cancel before the vendor accepts your order, the charge is automatically reversed and no money ever clears your card. If the vendor cancels after accepting, our system automatically issues a full refund within minutes (funds typically land back on your card within 5–10 business days, depending on your bank).

If something is wrong with a delivered order, email hello@getbayti.com and we will handle the case individually. We do not have a strict time window for reaching out, but the sooner you do, the more we can do.

5. Vendor responsibilities

Vendors are independently responsible for:

  • Cooking, packaging, and (where applicable) delivering the food they sell.
  • Sourcing halal ingredients consistent with the halal commitment they signed at onboarding, and accurately describing their food.
  • Complying with their state’s cottage food, restaurant, or retail food laws, as applicable to their vendor type.
  • Collecting and remitting any sales tax their state requires for the items they sell. Bayti does not collect sales tax at checkout on their behalf; vendors selling taxable items include the tax in their listed price and file directly with their state.

Bayti screens vendors at onboarding (the halal commitment, identity verification via Stripe Connect, basic business information) but does not inspect home kitchens. Food prepared by home chefs is governed by the relevant state’s cottage food rules and is plainly disclosed as such on the chef’s storefront.

6. SMS messaging program

Program name: Bayti

Description: Bayti sends transactional SMS related to orders on the marketplace. Vendors who opt in receive a text when a new order arrives so they can accept and start preparing it. Customers who opt in receive texts about their order’s status (accepted, ready, in transit, delivered). Bayti does not send marketing or promotional SMS.

How to opt in: Vendors enable a “text me when a new order arrives” toggle in their dashboard settings on getbayti.com; the toggle is OFF by default. Customers provide a mobile phone number during account creation and explicitly check an agreement to receive order-status SMS.

Frequency: Variable. You receive an SMS only in response to activity on your account (a new order arriving, an order status changing, etc.). There is no fixed weekly or monthly cadence.

Message and data rates: Standard message and data rates may apply, depending on your mobile carrier and plan. Bayti does not charge for SMS.

How to get help: Reply HELP to any SMS we send for a help message and our support email. You can also reach us anytime at hello@getbayti.com.

How to opt out: Reply STOP to any SMS we send and you will not receive further messages on that number. You can also disable SMS at any time in your account settings on getbayti.com.

7. Acceptable use

You agree not to use Bayti to: violate any applicable law; harass, threaten, or defraud another user; impersonate someone else; scrape or harvest data from the site; interfere with the operation of the service; or distribute malware. Vendors agree not to list items they cannot legally sell or whose halal sourcing they cannot honestly stand behind.

8. Intellectual property

The Bayti name, logo, site design, and software are owned by Bayti LLC. Vendor content (listing titles, descriptions, photos) remains the vendor’s, but by uploading it to Bayti the vendor grants us a non-exclusive license to display, distribute, and promote it on the marketplace.

9. Disclaimers and limitation of liability

Bayti is provided “as is.” While we take reasonable steps to keep the service running, we do not warrant that it will be uninterrupted or error-free. To the maximum extent permitted by law, Bayti LLC is not liable for indirect, incidental, or consequential damages, and our total liability to you for any claim arising out of your use of the service is limited to the amount you paid Bayti in the 12 months preceding the claim.

Nothing in this section limits liability that cannot legally be excluded (for example, willful misconduct).

10. Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Disputes that can’t be resolved by emailing us in good faith will be brought in the state or federal courts located in Delaware, and you consent to that jurisdiction.

11. Changes

We may update these terms from time to time. If we make material changes we’ll update the effective date at the top and, where required, notify you by email. Your continued use of Bayti after a change means you accept the updated terms.
